Do You Qualify for Medical Marijuana in NYS?

It is simple. NYS has two mandatory requirements for residents of NYS that must be fulfilled to qualify for MMJ which we will discuss below.

This assumes you are:

  • A resident of New York and can show proof *
  • Are getting treated in NY for the condition for which you are seeking MMJ
  • Are being certified by a NY Practitioner who has registered with the Department of Health (DOH) to recommend medical marijuana (we got that covered)
  • Able to apply to DOH to become a certified patient
  • Able to fulfill the two medical requirements of NYS law listed here

SECOND Requirement

You must have one of the following associated or complicating conditions to qualify:

Cachexia or wasting syndrome

Severe or chronic pain

Severe nausea


Severe or persistent muscle spasms 


Opioid use disorder (only if enrolled in a treatment program certified pursuant to Article 32 of the Mental Hygiene Law)

  1. Approved forms are limited to vaporized oil cartridges, capsules, and an oral tincture.
  2. Smoking is not permitted and the regulations prohibit edibles
  3. The marijuana flower is grown under strict supervision by NYS, and is all organic free of contaminants, mold, tested by Wadsworth Labs. 
  4. MMJ products are certified, labeled and quality controlled. 
  5. Certification expires after 1 year from the date it is signed or the date specified for early  termination
  6. Certification never expires for patients certified as terminally ill- only at death
  7. Patients under 21 can have a parent or legal guardian apply for them as designated caregivers
  8. All patients must pay Department of Health (DOH) a $50 fee to apply which can be reduced or waived if s/he is experiencing financial hardship
  9. Once the application is approved, DOH will issue the you a registry card that will include any limitations regarding forms or dosage made by the certifying practitioner
